Reminder - FDA to Enforce Cosmetics Facility Registration and Product Listings Starting July 1
Under the Modernization of Cosmetics Regulation Act of 2022 (MoCRA), cosmetics importers will need to register their facilities and list their products with the U.S. Food and Drug Administration (FDA). All importers subject to this requirement must ensure compliance by July 1, 2024, when the FDA will begin enforcement.
Per the MoCRA definition, a “facility” includes any establishment, located in the U.S. or abroad, that manufactures and/or processes cosmetic products distributed in the United States. This includes facilities that manufacture/process ingredients and laboratories that conduct batch testing.
Importers must also designate a “responsible person” to provide a list of all cosmetics products (including ingredients) marketed in the U.S. The “responsible person” is defined under this Act as the “manufacturer, packer or distributor” of the cosmetics product whose name appears on the product label.
The FDA has created an electronic submissions portal, Cosmetics Direct, for the registration & listing of cosmetic product facilities and products. This is not the only submission option, but it’s designed to aid the process with user-friendly data entry forms, initial validations, and other features:
